It is Lent. For Christians all over the world, this is the time of preparation before we remember the crucifixion and resurrection of Christ. Archbishop Chaput of Philadelphia issued a pastoral letter for Lent in which he said, “Evil preaches tolerance until it is dominant. Then tries to silence good.”

This leads us to the question – are we living in times of evil?

America has always been an aberration. In a sea of tyranny, we have been the shinning beacon of freedom and liberty. While men yearn to be free and live in liberty and peace, leaders want just the opposite. The overwhelming majority of leaders want power.

Power and freedom are a zero sum game. You cannot grow the power of the state unless you further restrict the freedom of the people. While some laws and government power are necessary for a well-ordered liberty, the creation of more and more arms of government does nothing but crush the liberty and freedom of man.

America for the last fifty years has really been an aberration. We have had the freest and most just society the world has ever seen. While it has not been perfect, which is the impossible standard those on the evil left would try to make us live up to, no nation has ever enjoyed the blessings of liberty as America has.

That is why Marxists like Barack Obama and Nancy Pelosi hate America and want to see America torn down.

They want to be the masters of the American people.

That is the problem we have had for a long time. Our elected officials have long since lost the concept of being public servants and now think they are public masters.

We see this with the IRS attacks on Tea Party and Liberty groups. We see this with Obamacare, which if left intact will destroy the American concept of the God given, inalienable right to life, liberty and the pursuit of happiness and replace it with the concept that Americans are simply chattel to the state.

We see this with the Obama Regime’s attack on religion in general and the Catholic Church in particular. We see this with the repeated declarations from the Obama Regime that every occasion from Christmas to the 9/11 remembrances is an excuse for public service. In other words, everything we do must be directed towards bettering the state. The left thinks we should worship the state and we are simply property of the state and should be grateful to it for whatever crumbs it throws our way.

America has always been a nation of optimism and hope, yet I will say for the first time in my adult life, my hope that this country will become a better country for my children is now fading.

On one side, we have a political party that is totally committed to destroying America. They purposefully engage in policies that will lead to a very obvious and predictable end. They continue to borrow money at such a rate that the only end result will be a national economic collapse.

Of course given that they are evil, this is not really a surprise. The fact they want to replace the freedom of America with a system that is primarily known for poverty, tyranny and mass murder is not a surprise either. The real surprise is that Americans have become so complacent that we just look evil in the face and then ask, “What time is American Idol coming on?”

It is heartbreaking to think that the nation that offered the world George Washington, Thomas Jefferson, James Madison, Alexander Hamilton, Abraham Lincoln and many more is now reduced to simply being a spectator at its own national suicide.

We need to begin pruning the tree of government in order to save liberty and freedom for America.

Who is willing to do this?

Mitt Romney, the most likely Republican nominee does not want to shrink government. He would like to expand it even more. Rick Santorum, whose chances of actually winning the nomination are almost gone would be better but not by that much. He too is a big government Republican. There were two in the race who actually talked about seriously reducing the size of government. There is Ron Paul whose candidacy has always been a joke and Newt Gingrich who now can only act as a spoiler if he can keep his campaign alive.

Our founding fathers feared a powerful national government and with good cause. They saw the abuses of tyranny with their own eyes. We have lived the last sixty years or so in peace and prosperity. With the exception of the few remaining World War Two vets, almost none of us even have a clue what tyranny is.

Our founding fathers created the Bill of Rights and set restrictions on the power of a national government to save us from that tyranny. Our individual state governments are the ultimate defense our founding fathers planned for the people against an imposing federal government.

With the real possibility that the Supreme Court may declare Obamacare Constitutional and the other usurpations the federal government is making on our liberty and freedom, we must now look to the states to protect our rights and our freedoms.

If you had to peg the two biggest sponsors of Obamacare, it would be the American Medical Association and the Insurance Industry. Now they are combining to shred the Constitution again. Unfortunately some of the Republicans are going along with what can only be called a reward for Obamacare. They are now tying the repeal of one of the worst parts of Obamacare to a hideously unconstitutional law.

What is it?

H.R. 5 is a really bad bill that imposes national caps on medical malpractice tort claims.

Now, some groups in Washington are attaching H.R. 5 to the repeal of what is known as the IPAB or Independent Payment Advisory Board. IPAB is sometimes called a death panel. It is a creation of Obamacare that will gut the rates Medicare reimburses Doctors.

IPAB is as unconstitutional as Obamacare, as it creates a panel that controls the expenditure of money without either Judicial or Congressional oversight.

Repealing IPAB is a good idea. No, repealing IPAB is a great idea. Congressman Phil Roe of Tennessee had over twenty Democrats agreeing to the bill that would repeal IPAB.

Now, some of the powers that be in Washington want to reward the American Medical Association and the big Insurance Companies by putting tort reform into the bill that kills the IPAB.

First, this will have the effect of killing the IPAB repeal bill. It will be a Republican only venture, which means in will die in the Senate. More importantly, this type of federal tort reform is totally unconstitutional. It is as unconstitutional as Obamacare.

H.R. 5 proposes to put caps on $250,000 on non-economic damages and regulates the fees attorneys can charge.

Tort law is the exclusive province of the state. Even in federal courts, if you sue and can trigger Federal Jurisdiction, the law that still governs the case is state law. It has been this way since 1789. Further laws governing attorneys and their fees are exclusively in the province of the state, not the federal government.

If the federal government can reach into the states and impose the kind of restrictions H.R. 5 imposes on state laws, then there is no purpose in having states. If the federal government can do this, the 10th Amendment no longer exists.

The House has just released the amendment process for this bill, called Help Efficient, Accessible, low-cost Timely Healthcare (HEALTH). Representatives are only given until next Monday to submit amendments. The problem is that the House is in recess until the afternoon of the 19th. Many Congressmen are either in their districts or on fact-finding trips.

In short, someone wants to make sure there are no amendments to this really bad bill.

Why some in the House leadership are obsessed with rewarding the very groups that gave us Obamacare is beyond me.

Some conservatives complain opposing unconstitutional tort reform rewards the trial lawyers. The trial lawyers may benefit from stopping unconstitutional tort reform, but we fight to protect the Constitution. In this case, the trial lawyers are with us supporting the 10th Amendment.

Our founding fathers thought so much of the right to a jury trial that the 7th Amendment to the Constitution was the only one that passed unanimously.

Call your Congressman today. Tell them that you want the IPAB repealed but you want that repeal to be a clean bill. Tell them not to tie H.R. 5 or tort reform into the IPAB repeal.

We can kill a huge part of Obamacare. That is, if no one will screw it up!

Is there any doubt that John Boehner is the worst Speaker of the House of Representatives ever? Under his leadership, spending has gone up dramatically. Instead of cutting spending as he was put in power to do, he has contributed to even more red ink. Under his leadership, there has been no meaningful attempt to repeal Obamacare.

Now he is doing something else that only solidifies his position as the worst Speaker ever.

What is it?

John Boehner has decided to advance a Medical Malpractice bill to the floor of the House as a part of a deal to repeal the Independent Payment Advisory Board. This Board is part of Obamacare and exists allegedly to cut the costs of Medicare.

Medical Malpractice is not one of the sexy issues people get involved in such as spending. A lot of conservatives take a look at the issue of Federal Medical Malpractice laws and say screw it; this only benefits the trial lawyers.

Wrong!

The Med Mal bill that John Boehner is going to allow to go forward to the floor of the House effectively limits non-economic damages to $250,000 and limits attorney’s fees.

Here is a quick question.

Can someone show me in the Constitution where such a concept is allowed?

The laws regarding Torts, lawsuits and attorneys’ fees are regulated by the States. In other words, the States govern all attorney licensing and fee regulation. They have since 1789. If you sue someone in Federal Court for a Tort, such as Medical Malpractice, the Federal Rules of Procedure may control the case, but the laws that govern the case are state laws enacted by the state legislature.

If the Federal government can simply impose these laws on states, it has the net effect of erasing the states. The Tenth Amendment will become null and void.

As a practical matter, the primary beneficiary of this law is the American Medical Association. You remember the AMA. They were one of the leading voices behind Obamacare. Why are the Republicans rewarding the AMA?

The AMA is like John Boehner. The AMA could not find the Constitution, if it knew where to look and even if it found the Constitution, it could not understand it.

The Med Mal legislation is as unconstitutional as Obamacare is. Perhaps that is why the AMA likes it so much.

If the Federal government can reach down and tell states how tort law must be handled, and tell lawyers what their fees can be, what will stop them from telling doctors what their fees can be? Or for that matter what about plumbers or any other occupation?

If the Federal government can tell people in a profession how much they can charge, how much of a stretch is it before the Federal government starts regulating how many people can enter a profession?

Sort of sounds like our old friend, the former U.S.S.R. doesn’t it?

In short, this is a huge overreach by the federal government.

Does anyone remember the text from the Declaration of Independence? Among other things, the Declaration says, “He has erected a multitude of new offices, and sent hither swarms of officers to harass our people, and eat out their substance.” This line could easily be written about the Federal Government today.

So much of what the Congress and the Federal Government does is blatantly unconstitutional. This is one more overreach.

We must stop this Congress from reaching beyond the limits of the Constitution and imposing laws from Washington that our founding fathers never intended them to enact and never intended for them to have the power to enact.

Call your Congressman this upcoming week and tell him or her that Federal Medical Malpractice is unconstitutional. Tell them to follow the Constitution and vote against this bill that is as unconstitutional as Obamacare!

Dear Gloria,

Shut the hell up!

As someone who is a huge believer in the idea of free speech I actually find it painful to say that. On the other hand, you are clueless and dangerous to freedom so on second thought maybe it is not that painful.

You sent a letter on March 8 demanding that Rush Limbaugh be prosecuted in criminal court for his comments about professional feminazi Sandra Fluke.

Allegedly you are a lawyer but it is painfully obvious you slept through law school. Since you slept through law school, let me give you a clue. There is something called the First Amendment.

Since you missed it, it reads:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

I realize you are one of those people who wants the Constitution repealed and think that conservatives should be prosecuted and imprisoned. But this is America. The First Amendment protects us. Rush is free to make his comments about Sandra Fluke and I am free to point out that you are an idiot.

Why don’t you relocate to Cuba or Venezuela, since the governments there share your view of freedom and liberty.

Real Americans are tired of socialists like you who want to tear down the greatest nation in the world. We are tired of you trying to criminalize conservatism. We are tired of your Botoxed brain damaged blathering.

You are not an advocate. You are a joke. As Kristin Powers pointed out, liberals scream bloody murder when someone says something about a liberal woman but are absolutely silent when conservative women have much worse things said about them. Michelle Malkin has had attacks made on her that make the comments about Sandra Fluke sound like they came straight from Sunday School. Where were you when she and other conservative women were being called every name in the book? Out scheduling your next face lift?

Rush Limbaugh has the First Amendment to protect him and so do I.

And when I point out you are an absolute raging moron and proof of life after Botox brain death, well truth is an absolute defense.

To call this one unbelievable is an understatement.

The Obama Regime is considering giving some of our most important classified information to Russia!

Which is the most alarming part of that statement? Russia, classified information or GIVING?

In testimony before Congress, Deputy Defense Secretary Brad Roberts confirmed that the Party of Treason is living up to its name.

To ally Russian “fears” the Obama regime is considering giving them sensitive, classified data about our Aegis defense systems.

Aegis is the defense system that is the centerpiece of our ballistic missile defense system and it is also the cornerstone of the Navy’s defense for our carrier battle groups.

Obama has surrendered on every defense plan that America has. He pulled our missile defense out of Europe and shut down some very promising programs including the airborne laser program.

The Russians have complained the missile defense is directed against them. That is the kind of bold-faced lie that Obama likes to use himself. Obama is buying this idiocy.

Either he is too stupid to be President if he believes the Russians think they are threatened by a missile defense system or he wants to help weaken America.

If we share our classified information about our Aegis missile system with Russia, does anyone really believe the information would stay with Russians? The electrons on the email will not even have cooled off before it is shared with Chinese, the Iranians and any other nation that does not like America.

Does anyone really believe that Obama does not know this?

Destroying America’s power, particularly America’s military power, has been a primary goal of the Obama Regime. Obama has gutted our military. While he has been on a spending spree that has the only purpose of bankrupting America, the only department he has insisted make real budget cuts is the Defense Department.

Our Air Force is now being shrunk to the lowest level since World War 2. The Army and Navy are being shrunk to their lowest levels since World War 1.

Many of the weapons systems we rely on for our defense are systems that were a part of the Reagan military build up

This means two things. First, it means they are outdated and need to be upgraded in order to keep our military the strongest in the world. We cannot defend ourselves with 30-year-old jet fighters. Even Russia has newer fighters than we do.

The second thing is, much of this gear is simply wearing out. Tanks, planes and ships wear out and must be replaced. Obama is quit happy to see this happen without replacing any of them.

It is bad enough that Obama is systematically destroying our military through budget cuts and planned elimination of our defense capabilities, but now they want to give away some of our closest held military secrets. The end result of this could be the death of Americans and the loss of American military power.

Congress must stop Obama now.

It is time for us to hurt Iran. It can be done easily and without military action. It is time for America to avenge what was done to Americans by the Iranians. You can help.

How?

In 1983, Iran used a suicide bomber to attack the Marine Barracks in Beirut Lebanon. 241 American Marines died in that attack. Hundreds of others were injured.

The survivors, the injured and the family members of those who gave their lives for their country, sued Iran. They received a judgment of $2.6 billion against Iran after a Federal Court Judge found Iran to be liable for the attack. A second lawsuit was filed alleging that Iran was liable for the 1996 Khobar Towers attack that killed 19 members of the United States Air Force. The survivors of Khobar Towers also sued Iran and again a Federal Judge found Iran liable and ordered a judgment.

Lawyers refer to a judgment where there are no assets to pay the judgment as a “paper judgment.”

Under almost any other circumstances, a case like this would mean a paper judgment for those survivors. After all, Iran is not going to pay.

But there is a way to make Iran pay and bring justice for these American heroes.

The attorneys who represented the families discovered $1.8 billion in funds belonging to the Central Bank of Iran in a bank in New York! This money is frozen and Iran cannot get it back at the moment.

We need to make sure they never get that money back.

A bill is pending in Congress that will make certain that frozen Iranian money goes not back to Iran where it might be used to advance terrorism, but to the American survivors and family members of these two attacks.

Let’s roll!

If Congress does not act, Iran might get that money back. There are two bills pending that would make sure that money goes to the families of the Marine Barracks bombing and the Khobar Towers bombing victims.

The first bill is in the House. It is H.R. 4070. The Senate version of the bill is S.2101.

Iran is our enemy. They hate us. They want to destroy Israel and the United States of America.

They hate us because they are evil. You cannot rationalize with evil people. You can only fight them and ultimately destroy them.

Taking this money away from Iran and making certain it cannot be used to advance terrorism is a great idea. Giving that money to the Americans who have been the victim’s of Iran’s terrorism is not just justice it is payback.

If Congress does not act, the order freezing the Iranian funds could be lifted. Can you imagine the celebration in Tehran if they get their money back? Just on general principles does anyone doubt Iran would not use some of this money for terrorism?

Call your Congressman and Senator today. Ask them to support and sponsor H.R. 4070 and S.2101.

Let’s hit Iran in the wallet and get some justice for American service members and their families.
